Arkansas Senator Tom Cotton asks Attorney General nominee Merrick Garland if he regretted the fact that Timothy McVeigh received the death penalty since executed for bombing the Murrah building in Oklahoma City, Garland supporting that as we became a judge supporting the death penalty in that individual case but had developed concerns about the death penalty in the 20 years since based on exonerations of people who are convicted, arbitrariness or randomness an application, disparate impact on Black Americans and other communities of color, asked if he would approve the death penalty if that occurred again as Attorney General responding that depended on policy, adding if the president asked to develop a policy or moratorium that would apply across the board, no point having a policy if one made individual discretionary decisions.
