INFORMATION: -THIS IS ONLY AVAILABLE in 4:3 with the Blue-rimmed slate. The man suspected of killing Kansas abortion Doctor George Tiller is now facing charges. Fifty-one-year-old Scott Roeder appeared in court by video Tuesday afternoon where he was charged with first degree murder and two counts of aggravated assault. The judge read Roeder the charges against him and ordered him to be held without bond. The judge also issued a no contact protective order for any of the state's witnesses and approved Roeder's request for a public defender. Roeder's preliminary hearing was scheduled for June 16th. Doctor Tiller was shot to death Sunday morning (5/31) while ushering at his church in Wichita. Witnesses exchanged words with the shooter and were able to give police a description and license plate number. Roeder was spotted in his car a few hours later and taken into police custody. People who know Roeder say he has radical views and ties to anti-government and anti-abortion groups. Dr. Tiller was well-known for performing late-term abortions. District Attorney Nola Foulston says her office decided not to pursue the death penalty because she says the first-degree murder charge was appropriate for the facts and circumstances of the case. SUPERS: Wichita, KS Nola Foulston District Attorney VIDEO INFO: SOT- Nola Foulston: "This is not a death penalty case. WHY IS THAT? The state of Kansas requires a number of predicate factors, and special circumstances. And under the facts and circumstances that are known at this time, the election has been to go with a first degree murder." -EDIT- SOT- Nola Foulston"I will say that the state has filed a charge of premeditated, unlawful, killing of another human being, George Tiller." QUESTIONS ARE YELLED OUT BY REPORTERS. SOT-Nola Foulston: "One might worry about jury selection if we felt that there was some impediment to an individual receiving a fair trial. We have, and will continue to have a jury base in our community that is able to listen to evidence and make determinations without being influenced from outside sources. And that's one of the reasons that we do not discuss evidence, witnesses, witness testimony, and other information." -EDIT- SOT- Nola Foulston:"We have elected to file this case, not as a capital murder case but as a first-degree, premeditated murder." ****************************************************************************
