SOT: (English) Captain Dan Bower "At approximately twelve-ten yesterday, September 11th, we had an officer who had just completed a traffic stop on the PCH (pacific coast highway) south of Dune Road and at the completion of the stop - the officer's attention was drawn to a black Mercedes because of squealing tires. The officer followed the vehicle, and the vehicle was driving very erratically, weaving side to side. The officer made a traffic stop on the car - the solo occupant driver was Nick Nolte. The officer asked Mr Nolte to perform a series of field sobriety tests. Based upon the results of those tests as well as Mr Nolte's demeanor and the driving observations - the officer formed the opinion that Mr Nolte was under the influence of alcohol and or drugs. Mr Nolte was transported to a location where a blood test, a blood sample, was taken - the results of which we won't have for a few days and then he was booked in the Los Angeles County Sheriff's Department substation for misdemeanor DUI (driving under the influence). About six to eight hours later he posted the standard 25-hundred dollar bail which is the standard bail for misdemeanor DUI and released." AP Photos 5. AP Stills of Nolte's arrest KTLA 6. SOT: (English) Captain Dan Bower "He was co-operative through the whole process so it was a non-eventful type arrest. Mr Nolte responded to all the requests that were made of him. The officers describe him as being highly intoxicated. The officers described him as very co-operative but highly intoxicated. (Q: We heard he looked like a sloppy drunk. Can you describe what he was like?) You know, I didn't observe him myself and I have given you the information the officer gave. His information was that Mr Nolte was highly intoxicated." 7. Still shot of mug shot 8. SOT: (English) Captain Dan Bower "Just that he was highly intoxicated and that his speech was slow and slurred and all the typical symptoms of somebody who's under the influence of something and that would include all the things that you just said (like drooling and the eyes and things like that - so that is correct.) That is correct, yes." 9. Cutaway cameraman AP Photos 10. Stills of Nick Nolte being arrested ABC FOOTAGE 11. Various shots of Nick Nolte under arrest APTN MATERIAL 12. The actor - who has appeared in the aptly named 'I Love Trouble,' 'Affliction' and 'Down and Out in Beverly Hills.' He was nominated for an oscar for his role in 'The Prince of Tides' and will be appearing in the upcoming feature film of 'The Hulk.' The oscar nominated actor is free on bail - but charges are pending as officers await the return of blood tests that will confirm which substances Nolte is believed to have been using. The officer - who didn't recognise Nolte - had noticed a black Mercedes driving erratically along California's Coastal Highway outside of Malibu. The 61-year-old actor has a long history with alcohol. He had even referred to himself as a 'functioning drunk' at one juncture - but had reportedly claimed to have given up the juice in the mid-1990s. On condition of anonymity - one arresting officer said a breathilizer test revealed no use of alcohol. The actor's car was impounded but no drugs or alcohol were found. The actor's publicist, Arnold Robinson, had no comment.
