The Democrats first went to a state appeals court Wednesday night after the exhausted Miami-Dade election board stopped its counting - leaving Al Gore without a hope of picking up votes there and cutting into George W. Bush's lead in the state's presidential election. The state Supreme Court had set a 5 P.m. Sunday deadline for Miami-Dade and two other counties to get recount totals into the state so the election could be certified. Gore spokesman Doug Hattaway said Thursday the state high court was being asked to order the Miami-Dade board to resume and complete the full hand count or at least the 10,000 votes - those with possible indented chads that machines didn't read the first time. SOUNDBITE: (English) "Well, the law actually says that if you undertake a recount and find that there is enough discrepancy in the votes to effect the outcome of the election, the law actually requires you to do a hand recount. And the Miami-Dade board doesn't have the discretion there. And the Supreme Court ordered the canvassing board to count the votes. We don't think their deadline is an excuse to stop counting." SUPER CAPTION: Doug Hattaway, Gore Campaign Spokesman The Florida Supreme Court Spokesman says the justices are away from the courthouse today to celebrate Thanksgiving, but they are being given the Gore campaign's documents as soon as possible. SOUNDBITE: (English) "Vice President Gore's attorney filed a petition, a writ of mandate seeking other relief in the court. The court now has the matter under advisement. We have been contacting the justices wherever they are located, making sure that they get copies of this petition to read. The court is aware of the urgency of this particular matter, and will be doing the best it can to come up with a determination as quickly as possible." SUPER CAPTION: Craig Waters, Florida Supreme Court Spokesman Waters said the Bush attorneys would have a chance to respond to the brief if the claim is not rejected outright by the court. Election officials in Broward County, Florida are giving up their Thanksgiving holiday to continue the tedious but critical hand recount of contested ballots in the November 7 presidential election. Most of the county's ballots have already been counted, but 2 thousand remain in question as to who voters intended to vote for. UPSOUND: (English) "...But they voted for nothing else. And it would appear to me that if they took the trouble to go to the polling place on election day they would have voted for somebody, and it appears they voted for George Bush." Normally, a hole is punched in the card when a vote is cast. Meanwhile, Texas Governor George W. Bush took a morning jog outside the governor's mansion in Austin. His running mate, Dick Cheney, was hospitalized yesterday in Washington, DC after suffering a mild heart attack.
