Now how can he be, which is the basis of their attempt to argue, having anything to do with this body? They say he's an executor. Wide shot of hearing WSVN-TV - No Access Miami/Mandatory Courtesy: WSVN FILE - Hollywood, Florida - February 8, 2007 11. Anna Nicole Smith's body being brought to medical examiner's office STORYLINE: There were fireworks in a Florida courtroom on Thursday during a hearing about the custody of the remains of Anna Nicole Smith. Smith died on February 8 after collapsing at a Florida hotel. She was the widow of Texas oil tycoon J. Howard Marshall II, whom she married in 1994 when he was 89 and she was 26. She had been fighting his family over his fortune since his death in 1995. It seems nearly everyone with links to Smith was trying to be heard at the Fort Lauderdale hearing on Thursday. The circuit judge presiding over the matter will determine who gets custody of her remains. Judge Larry Seidlin said his overriding concern was "what's in the best interest of the child," Smith's five month old daughter Dannielynn. Smith's body has been at the Broward County Medical Examiner's Office since she died. The judge says it will stay there until he makes his ruling. Smith's longtime companion, Howard K. Stern, and her estranged mother, Vergie Arthur, each hope to win control of the body. Stern wants to bury Smith in the Bahamas. Her mother wants her buried in Texas. Photographer Larry Birkhead, who claims to have fathered the former centrefold's baby daughter, hopes DNA will prove his case. Birkhead simply wants to prove he is the father of Dannielynn, who potentially could inherit millions. Prince Frederic von Anhalt, the husband of the actress Zsa Zsa Gabor, has also said he had a decade-long affair with Smith and may also be the father. He said he plans to file a paternity challenge in court and wants a DNA test.

USA: ARMS SMUGGLING: SUSPECTED IRA MEMBERS APPEAR IN COURT
TAPE_NUMBER: EF99/0838 IN_TIME: 20:20:26 AND EF99/0840 03:20:15 LENGTH: 01:23 SOURCES: APTN RESTRICTIONS: FEED: VARIOUS (THE ABOVE TIME-CODE IS TIME-OF-DAY) SCRIPT: English/Nat United States prosecutors said on Thursday that three people arrested on charges of smuggling weapons to Ireland should be held without bail because they are flight risks. All three are charged with violating the Arms Export Control Act, a U-S law regulating the export of firearms and other dangerous materials to known terrorist organisations. Conor Anthony Claxton, Siobhan Browne, and Anthony Smyth had airline tickets to Ireland in their possession when they were arrested on Monday in Florida and prosecutors claim Claxton admitted to working for the Irish Republican Army, although defense attorneys deny he made any such confession. The three are accused of exporting weapons without a licence, mailing concealable firearms without a licence and conspiracy. The three suspects, Conor Anthony Claxton, 26, Siobhan Browne, 34, and Anthony Smyth, 42, appeared in a Fort Lauderdale Federal Court on Thursday. Prosecutors told the Court the three had airline tickets to Ireland in their possession when they were arrested Monday. Judge Barry S. Seltzer denied bail for all three defendants, saying the risk of their fleeing was too high. Claxton was arrested in Deerfield Beach by the F-B-I's Joint Terrorist Task Force, acting on a criminal complaint filed by the U-S Attorney's office. Smyth and Browne were arrested in suburban Fort Lauderdale on the same complaint. In Ireland, two women and a man identified by U-S law enforcement sources as Claxton's brother were detained on Tuesday by Irish police under the Offences Against the State Act. Irish police found six handguns and 150 rounds of ammunition at a rented vacation cottage 20 miles outside the city of Galway in western Ireland. Authorities won't confirm whether the ring, which bought at least 50 guns destined for Ireland and had ordered as many as 35 more in South Florida, is affiliated with any sect of the Irish Republican Army. Assistant U-S Attorney Richard Scruggs said that when Claxton was questioned by the F-B-I about his employment, he replied -- quote 'My job is the IRA.' Defence attorney Abe Bailey denied that Claxton made such an assertion. Questioned by reporters outside the court, Bailey said he still needed details from his clients to refute the allegations of I-R-A involvement. SOUNDBITE: (English) (Question: "From what the prosecutor said, do you think he was referring to the proper I-R-A, or do you think he was referring to the dissidents?") "I think that was not made clear, I think it's just general I-R-A, I don't think it was discussed whether there was anything distinguish, about it." (Question: "So do you think the prosecution know what they are talking about?") "Well I'm not sure I'm not going to point any fingers but I'm sure later on it will all come out, whether or not they are splinter groups are confirmed or there is, or whether or not he is a member of any of these groups." SUPER CAPTION: Abe Bailey, Defendants' lawyer The weapons were intercepted by British authorities July 6 after they opened one package that contained a .357-caliber Magnum revolver mailed from Fort Lauderdale and addressed to a resident of County Meath, northwest of Dublin. Authorities searched the postal warehouse and found eight more weapons and ammunition packages falsely marked as containing other items, such as toys, video cassette players, stereo components, computers, baby clothes and radios. Federal agents traced the packages to a Boynton Beach weapons dealer who told agents that Browne and Smyth approached him at gun show at the Fort Lauderdale Armory in April. Browne selected five handguns and they agreed to meet at the dealer's home a few days after the show. On April 28, the dealer allegedly sold Browne the five guns plus another revolver. The defendants face up to 20 years in prison, if convicted. SHOTLIST: xfa Fort Lauderdale, Florida, United States - July 29, 1999 1. Wide view of court house 2. Sign outside court house 3. Flag 4. Victor Patino Fomeque, once a leading member of the former Cali drug cartel, arrived in Miami in the afternoon and was brought to the U-S Marshall's Office for processing. His first court appearance is set for Monday in Fort Lauderdale. Patino was charged in a July 2001 indictment there with conspiracy to import cocaine and heroin and conspiracy to commit money laundering in the southern district of Florida. Patino served seven years in a Colombian prison for drug trafficking. In April, just two months after being released, he was arrested on a U.S. warrant by police during searches of homes and businesses in downtown Bogota after a string of bombs hit the capital. The Cali cartel once controlled 80 percent of the world's cocaine trade, taking over after the demise of the Medellin cartel, whose leader, Pablo Escobar, was killed by Colombian police in December 1993.

JOHN GOODMAN VERDICT
FTG OF COURT HEARING OF JOHN GOODMAN AND POST HEARING PRESSERS A Florida jury has convicted Palm Beach polo mogul John Goodman of killing a 23-year-old motorist while driving drunk two years ago, according to news reports out of West Palm Beach. Goodman, 48, gained notoriety outside Florida last month when it was revealed he had adopted his 42-year-old girlfriend as a legal ploy against a lawsuit filed by the parents of the victim, Scott Wilson. Goodman was taken into custody after the verdict and faces up to 30 years in prison for DUI manslaughter and vehicular homicide at his April 30 sentencing, the Fort Lauderdale Sun-Sentinel says. Driving his black Bentley drunk in February 2010, Goodman, founder of the International Polo Club Palm Beach, ran a stop sign in Wellington and smashed into Wilson's car, police said. Wilson's car landed in a canal, where he died. Goodman fled and waited nearly an hour to call 911. His blood-alcohol was more than double the legal limit, the equivalent of 16 drinks, police said.

Various of Anna Nicole Smith outside US Supreme Court THE DISPUTE CONTINUES Lawyers in Florida spent a third day on Saturday, arguing in the custody dispute over Anna Nicole Smith's body. The former glamour mode's will, written in 2001 and released on Friday, leaves more questions than it answers about who will inherit Smith's potentially huge estate. The 19-page documents put no figure on the possible value of Smith's estate. Her body was embalmed on Saturday but it's still not clear what will happen next because the will made no mention either of Smith's preference for funeral arrangements. It named Smith's lawyer and boyfriend, Howard K. Stern, as her executor, stipulating that he hold her estate in trust for her son Daniel Smith. But Daniel died last September aged 20, apparently from drugs-related causes, days after the birth of the Smith's daughter, Dannielynn. And the will explicitly leaves out anything for anyone other than Daniel Smith. "I have intentionally omitted to provide for my spouse and other heirs, including future spouses and children and other descendants now living and those hereafter born or adopted," Smith said in the will, which was signed under her legal name, Vickie Lynn Marshall. Circuit Judge Larry Seidlin ordered the release of the will in the latest round in the tangled legal dispute that erupted after the voluptuous blonde died at a Florida hotel February 8, 2007, at age 39. The cause of death is under investigation. Stephen Tunstall, a lawyer for Smith's estranged mother, Virgie Arthur, had questioned the veracity of the will before its release, calling it a "phantom will," but did not answer questions about the document as he left court on Friday. Ron Rale, once a lawyer for Smith and now representing Stern in his case to prove fatherhood of Dannielynn, said he was aware that the will alone would not settle the dispute. The document was released hours after Seidlin - who is trying to settle a three-way dispute over the body - agreed to the embalming. Two embalmers started that process Saturday morning at the Broward County medical examiner's office, after being searched for objects like cameras and signing a confidentiality agreement that stated they would not talk about, write about, photograph or draw the body, said the medical examiner, Doctor Joshua Perper. "They started basically at 9:15 the embalming. They did an excellent job, and the body will be ready for viewing with no problem. In other words, she's basically looking like she looked in life or very, very close to that," said Perper. Meanwhile mourners have been leaving flowers outside the medical examiner's office. One woman was seen taking pictures of the memorial and offering prayers at the site. Stern and Arthur are fighting over where Smith should be buried and who will get custody of the baby. Stern, who is listed as the baby's father on the birth certificate, says Smith wanted to be buried next to her son in the Bahamas. Arthur wants her buried in Smith's home state of Texas. A third figure in the dispute, photographer Larry Birkhead, claims to have fathered Dannielynn and won permission to take DNA from Smith's body in hopes of proving it, a request that held up the embalming. The will made no mention of Smith's mother, who the starlet had venomously said she would never speak to again. The judge ordered Stern, who was in the Bahamas and did not attend Friday's hearing, to appear in court Tuesday when the case resumes.

Flowers and palm trees ANNA NICOLE JUDGE BREAKS DOWN Anna Nicole Smith is to be buried in the Bahamas, alongside her dead son, it was announced Thursday after a tearful judge left the decision up to the guardian for the model's baby daughter. Richard Milstein, the court-appointed guardian of five-month-old Dannielynn, announced the plans not long after a judge gave him control of Smith's final resting place. He gave no time frame for the burial. Circuit Judge Larry Seidlin's ruling came a full two weeks after Smith died at a Florida hotel aged 39 of still-undetermined causes. It followed warnings by the medical examiner that Smith's body was rapidly decomposing. Announcing his decision, the judge, who was visibly distressed, told the court: "I want her to be buried with her son in the Bahamas. I want them to be together." Smith's companion Howard K. Stern had wanted her to be buried next to her son Daniel, who died of apparent drug-related causes last year, while Smith's mother Virgie Arthur wanted her back in the family plot in Texas. Stern sat hunched over a table with his hands folded as he awaited Seidlin's ruling and he wiped away tears with a tissue after the order. Arthur covered her eyes. Before the Florida ruling, two consecutive witnesses called by Arthur's lawyers unexpectedly acknowledged that the starlet should be buried in the Bahamas next to her late son Daniel. The statements by Ford Shelley, who claims to own the Bahamas home where Smith lived with Stern, and Billy Smith, Daniel's biological father, were a surprise. Billy Smith, talking to the court via a speaker-phone, said he did not want his son to be exhumed as Arthur has said she wanted to do and that Anna Nicole and her son should be buried "side by side". Outside court Stern told the media, "I am very happy with the decision. All that mattered to me was that Anna's wishes were carried out and that she is going to be with her son." After the ruling was announced, Medical Examiner Dr. Joshua Perper said the order was under appeal, but did not elaborate on who had filed the appeal. "I think that the chances of the appeal to succeed very poor," he added. Smith died February 8 in a Florida hotel, but the cause is still unknown. The dispute over the burial was one of many surrounding the former Playboy model. Stern is listed as Dannielynn's father on the birth certificate, but Smith's ex-boyfriend, Larry Birkhead, has said that he is the father. Before he adjourned his court, Judge Seidlin urged the two men to "give the kid the right shot".
