The accused were arrested in July after the boat they were piloting capsized just outside Havana, killing one of their 11 passengers. The men - both Cuban emigrants themselves - are accused of charging passengers up to eight-thousand U-S dollars each to smuggle them out of Cuba and transport them to Miami. If found guilty, the two men could be the first to be sentenced to life under a new toughening of Cuba's penal code. The case of the U-S residents was heard in a small court house on the outskirts of the capital, Havana, on Friday. Relatives of the accused were on hand to hear the testimonies of Joel Dorta Garcia and David Garcia Capote. Also on trial was Pedro Cordova Gonzalez, a Cuban living on the island who is accused of working with the two men. The men are standing accused of attempting to smuggle Cubans to Florida. They were arrested on July 3 after the boat they were piloting off the coast just outside Havana capsized. A 45-year-old attorney was killed in the accident. Also aboard the boat were 11 others, including five children. It was not immediately known how long the trial would last, but Garcia Capote's relatives expected it would wrap up later in the day. Attending the trial was Capote's mother, a sister, his mother-in-law and his wife, Miladys Rodriguez, with whom he has a four-year-old son. Relatives deny government accusations that the two men charged their passengers up to eight-thousand U-S dollars each to transport them to Miami. They maintain that the pair had come to pick up family members and take them back to Miami. At least six of those aboard the boat were related to Capote, including his sister and brother-in-law. Capote had himself emigrated to Miami in April. After a surge in illegal departures for the United States, Cuba in late July cracked down on the practice of alien smuggling. Cuban authorities said that the crime picked up this year as more smugglers with fast speedboats began carrying out the job. President Fidel Castro talked at length about the crime during a major speech last month, calling on the United States to abolish the Cuban Adjustment Act, a 1966 law that allows Cubans who reach U-S soil to apply for legal residency. Castro said that the law encouraged Cubans to keep trying to cross the Florida Straits illegally despite U-S-Cuba migration accords.
