(Anita Alvarez/Cook County State"s Attorney): "Our investigation has determined that Officer Van Dyke was only on scene for less than 30 seconds before he started shooting. In addition to the fact that all evidence indicates that he began shooting approximately 6 seconds after getting out of his vehicle."

Wide of Tucker working at desk STORYLINE Prosecutors say a 24-year-old Afghan immigrant now in police custody was on the verge of unleashing an attack in New York City on the anniversary of the September 11 2001 attacks. Najibullah Zazi was stopped by police on September 10 as he entered the city of Denver, Colorado, and federal prosecutors say he dropped his plans for an attack once he realised that law enforcement were aware of his reported plans, prosecutors said. Investigators say Zazi and three associates went from one beauty-supply store to another in a Denver suburb this summer buying chemicals to make explosives. Zazi was flown from Denver to New York on Friday on a US government plane. He is now in custody in Brooklyn, police said and will face charges of conspiracy to use weapons of mass destruction. Zazi denies the militant charge. He is set to appear for a hearing in Brooklyn on Tuesday. On Friday however, a another man arrested in an unrelated alleged bomb plot in Dallas, Texas appeared in court. The 19-year-old Jordanian national, Hosam Maher Husein Smadi, was arrested on Thursday and stands accused of parking what he thought was an explosive-laden truck in a garage beneath the 60-story Fountain Place office tower and trying to detonate it. The US Federal Bureau of Investigation (FBI) said they have had Smadi under surveillance since March. The agency says the suspect has repeatedly espoused his desire to commit violent militant activities. Undercover agents posed as al-Qaida members and set up a decoy car bomb, the FBI said. They say Smadi placed the car bomb in the garage of the Fountain Place tower, in Dallas, Texas. The FBI said Smadi then detonated the bomb from his cell phone but it could not explode as the undercover agents had built it with inert materials so the public was never at risk. Smadi mostly looked down as he was led into a federal courtroom in Dallas in handcuffs. Asked whether he understood his rights, he answered "Yes." Smadi is being represented by public defender Richard Anderson. Following the court hearing, Anderson told reporters had a lot of work to do in order to understand the case and how to defend his client. Anderson said he planned to be ready for Smadi's preliminary hearing scheduled for October 5. The sheriff's department in Ellis County, Texas, released dash-cam video of Smadi in custody in a patrol car. The video was taken on September 11 2009 after deputies arrested Smadi on a charge unrelated to the bomb plot. Smadi was charged with driving without a license or insurance and paid a 550 US dollar fine. Meanwhile, an American ex-convict described as an admirer of US Taliban fighter John Walker Lindh is being held in Illinois. Michael Finton is accused of trying to blow up a federal courthouse in Springfield on Wednesday. Federal agents arrested Finton Wednesday after he attempted to set off what he thought was a powerful bomb in a van outside a federal courthouse. In the Finton and Smadi cases, authorities say decoy devices were provided to the men by FBI agents posing as al-Qaida operatives. Both men are charged with trying to detonate a weapon of mass destruction, although they stressed that the two cases were unrelated and that both had no connection to Zazi. Security analyst Charles Tucker of the DePaul University School of Law said that in such cases, authorities have to perform a balancing act. Tucker said authorities must allow suspects to proceed just far enough with their plans to prove that they were serious about committing the crimes. However, he also noted that authorities must also keep a close watch on the suspects in order to prevent them from actually carrying out an attack. "The bigger concern is what happens if they get away at that point, what happens if they get wind of your investigation, they go underground, then they commit the crime that they were planning to, that's the real concern," Tucker said.

Police in Vermilion pulled over James Mosley for speeding. Out of the van, Mosley gives police a fake name, and when he stumbles on the heel-to-toe sobriety test he tells officers he's pigeon-toed. But it's back at the police station, where the trouble really begins. While officers give Mosley the option of taking a breathalyzer test, he becomes more agitated. Officers aim tazers at Mosley before using pepper spray to subdue him. Vermilion Police Chief Robert Kish says his men acted properly in a potentially explosive situation.

ROADSIDE TROOPER A MIRACLE SURVIVOR 2006
A 20-year-old Mandeville man has pleaded guilty to causing a wreck that nearly killed a Louisiana State Trooper. The trooper's dashboard camera captured the April 4, 2006, collision on tape, showing Belock's car slam into the trooper at nearly 70 miles-an-hour. Trooper Robert Harrison had just stopped a motorist for a traffic violation along Interstate 10 near Siegen Lane. The trooper was standing outside the vehicle he'd just stopped when Belock's vehicle slammed into him. Andrew D. Belock was sentenced to five years probation after entering guilty pleas on November 13th to first-degree vehicular negligent injury and possession with intent to distribute drugs, prosecutors said. Prosecutors say Trooper Harrison agreed to the sentence of probation so that Belock could remain employed and pay an undisclosed monthly restitution to the trooper. If Belock fails to make those payments, he could then be ordered to prison. In the videotape, Belock is eventually placed in the back of Trooper Harrison's patrol car. At that point, he uses his cell phone to call his girlfriend. Audio equipment within the trooper's patrol car captured what Belock told his girlfriend that night. "I feel asleep," Belock is heard saying. "I was going 70 miles-an-hour and got in a head-on collision, baby. This person might be dead." Trooper Harrison declined our request for an on-camera interview. However, he said he approved of WAFB 9NEWS airing the videotape of his accident in hopes it would remind motorists of the importance of slowing down and pulling into the opposite lane when approaching emergency vehicles.
BLACK CADDY INTO SNOW BANK CHASE 2008
A suspect involved in a robbery drove away Sunday, with police close behind. The high speed chase ended he slammed into a mini van filled with innocent people. The chase went from 90 miles per hour to zero in a matter of seconds. Sirens sounded as Franklin police chased a robbery suspect along Rawson Avenue, going as fast as 90 miles per hour. The suspect in a black Cadillac swerved in and out of traffic. Then, he sideswiped a white mini-van and crashed into a snow bank. “Rollover at 76th and Rawson,” officers reported to their dispatcher. Officers jumped out of their squad cars and drew their guns. “Show me your hands! Show me your hands,” they shouted. While police tried to arrest the driver, witnesses ran to help the family of three who were inside the mini-van. They were all taken to the hospital with minor injuries “Being in the intersection within 30 seconds of this happening, it is scary,” Witness Lisa Plewa said. It took half a dozen officers to finally get the suspect, 35-year-old David Martin, out of the car. They pulled him to the ground and took him into custody for causing what could've been a very deadly scene on Franklin’s busy streets.
