LAW ENFORCEMENT’S A DRAG 2009
A driver who was pulled over Friday night by an Ocala police corporal sped away with the officer's feet hanging out the driver's side door of his Volkswagen convertible. The driver, Bradford Sheldon, 44, of Gainesville, also tried to push Cpl.George Hunley out of the car as he drove at speeds in excess of 80 mph, according to the Police Department. Hunley, Sheldon and Officer Matt Sams, whose foot was run over, received minor injuries. Sheldon was charged with attempted murder of a law enforcement officer, kidnapping, aggravated battery on a law enforcement officer, resisting arrest with violence, two counts of resisting arrest without violence, reckless driving and driving on a suspended license. He declined an interview request from the Starbanner. Here's an account of the episode based on information from the Police Department: It all started shortly before 11 p.m. Friday, when Hunley noticed a blown headlight on a Volkswagen convertible in the 600 block of Northwest 10th Street. Hunley, who had been traveling in the opposite direction, turned around and stopped the VW in the 800 block of North Pine Avenue. Sheldon told the officer that he did not have his driver's license. He reportedly told Hunley it was a valid license and then gave him a name and Social Security number. Hunley checked the information, learned that it was false and called for backup. Then Hunley approached Sheldon, who buckled in the driver's seat, and asked for the keys. Sheldon refused to hand them over. Hunley reached in and tried to get Sheldon out of the car. Then a dashcam video shows the corporal, along with Officer Matt Sams, trying once again to remove Sheldon from the car. During the struggle, Sheldon drove off. A back tire rolled over one of Sams' feet. Hunley's upper body was in the car as the two continued to struggle. His feet were dangling outside. Hunley repeatedly told Sheldon to stop the car, but Sheldon continued to drive, telling the officer to "just get out," a police report says. They continued to struggle, with both men holding onto the steering wheel, the car door open and the VW traveling more than 80 mph. The report says Sheldon swerved the vehicle toward a guard rail at the bridge in the 600 block of North Pine Avenue. The car was damaged when it hit a raised median in the 900 block of South Pine Avenue. Hunley then turned the steering wheel to the left, which made the car turn onto Southwest 10th Street, where it stopped. Sheldon crawled out the passenger side window to escape. Hunley pulled out his Taser and stunned him. It appeared to have no effect, as Sheldon continued to resist. Hunley tackled him and placed him under arrest. Sheldon had just been release on Oct. 24 from Marion Correction Institution after serving more than a year for credit card fraud and cocaine possession.

DASHCAM CATCHES A SUSPECT BEING TASERED BY FLORIDA POLICE. ON A ROUTINE TRAFFIC STOP, THE MAN TAKES OFF AND LEADS POLICE ON A HIGH SPEED CHASE. KIA CHASE AFTER ROBBERY ENDS IN CRASH 2009
A grand jury this week criticized the Bradford County Sheriff's Office for endangering the public during a deadly car chase in February because it had no policy in force on when and how to enter into a high-speed chase. VEHICLE PURSUIT POLICY The sheriff recently adopted a car-chase policy but said the policy provides guidelines, not absolute rules. Robbery suspect James Lester Estes, 46, of Fairbanks died at the end of the chase on Feb. 3 when he was shot in the head and crashed the sport utility vehicle he had been driving after crossing into Alachua County. The Bradford County grand jury - like an Alachua County grand jury before it - ruled that the actions of the officers chasing Estes were lawful. In its presentment, the Bradford County grand jury said, "We discourage such a chase and use of deadly force unless absolutely necessary." The grand jury went on to write: "The circumstances involved in this incident put innocent people in harm's way, in part because there were no effective policies regarding pursuit situations in force at the Bradford County Sheriff's Office at the time." Estes, a suspect in a robbery at a Bradford County convenience store earlier that day, led law enforcement officers in the chase from Bradford County to County Road 225 and County Road 1475 in northern Alachua County. During the pursuit, Estes led officers through Starke and onto U.S. 301. Speeds at the time reached about 80 mph. Efforts to stop Estes by using techniques such as stop sticks - to deflate the tires on his car - failed because he unexpectedly turned onto side roads during the chase. Shots were fired at Estes both on U.S. 301 and shortly before he crashed in Alachua County. State Attorney Bill Cervone said Estes was hit by one bullet in the back of the head, causing him to lose control of the SUV he was driving and crash. Bradford County Sheriff Gordon Smith and Capt. Eddie Boatwright both fired at Estes or his vehicle during the pursuit. Smith previously said he fired when he was trying to direct traffic away from Estes' route on CR 229 and the man "made the move to come directly at me." Boatwright was riding with another officer and shot at Estes and his vehicle on U.S. 301 in Bradford County and just before Estes crashed in Alachua County. Smith, who had been in office about 20 days when the shooting occurred, said a pursuit policy adopted by the previous sheriff's administration in August apparently had not been widely distributed and was found on a CD on a lieutenant's desk. Former Bradford Sheriff Bob Milner disputed Smith's recollection. On Wednesday afternoon, Milner told The Sun he had put a policy into place when he first took office in January 1993 and that the policy was continually reviewed and updated like other policies at the agency. The car-chase policy that's now in place for the Bradford Sheriff's Office is similar to the policy at the Alachua County Sheriff's Office as well as policies at several other law enforcement agencies across North Central Florida. The grand jury noted that Smith recently had put a pursuit policy in place and urged the sheriff and his deputies to remember that the key to responding to similar future events "is the exercise of good judgment in following policy." Smith said his nine-page pursuit policy, which took effect April 22, is part of the ongoing training and education in which his staff participates. However, the sheriff said the policy is only a guideline. "Policies are guidelines, not laws," Smith said. "There are always reasons to justify going outside of the guidelines." For example, the recently adopted guidelines state, "Caravaning of vehicles during a pursuit situation is prohibited," and, "A pursuit will normally involve no more than two vehicles." In a 17-minute video of the chase and subsequent crash, at least seven law enforcement vehicles are seen pursuing Estes. The video was provided to The Sun by the State Attorney's Office in response to a public records request. The current policy also prohibits shooting at a moving vehicle, except when authorized by a captain or higher authority and when all other means have been exhausted and the suspect poses a threat if not stopped. Smith said that in the Estes case, the pursuit tactics, including the shooting, were justifiable because deputies did not know whether Estes was armed and because he allegedly had tried to run into at least one law enforcement officer and then refused to pull over when deputies were following him with their lights and sirens activated. After Estes' death, his sister Jacki Crews said her brother had left a note indicating he didn't want to be a burden and was upset about developments in a court case involving a relative. The charges in that case, in which his relative was a victim, had been reduced or dropped. A self-employed carpet installer, Estes also was dealing with financial issues, family members said. Alachua County sheriff's deputies had indicated Estes was a suspect in another convenience store robbery similar to the Bradford County case. No weapon was displayed in either case. Estes' sister said she did not believe her brother was trying to hurt anyone else but "was trying to escape a world that he could not simply cope in anymore."

A FLORIDA DEPUTY WAS WRITING A TRAFFIC TICKET WHEN HE WAS STRUCK BY A PASSING VEHICLE. HE WAS TRANSPORTED TO A FLORIDA HOSPITAL, AND RELEASED IN GOOD CONDITION WITH MINOR INJURIES. THE PATROL CAR WAS EQUIPPED WITH A VIDEO CAMERA SYSTEM AND THE VEHICLE THAT STRUCK ROGER LEFT THE SCENE. AFTER REVIEWING THE VIDEO, THE SUSPECTS VEHICLE WAS DESCRIBED AS A 1997 BUICK PARK AVENUE, WHITE IN COLOR. THE VEHICLE WAS MISSING THE PASSENGER SIDE MIRROR. THE MIRROR STRUCK THE DEPUTY AND WAS FOUND AT THE SCENE OF THE ACCIDENT. LATER THAT SAME DAY, A DETECTIVE SAW A VEHICLE MATCHING THE SUSPECTS DESCRIPTION AND MISSING THE SIDE PASSENGER MIRROR.

Police in Lake Wales, Florida are investigating a traffic stop that nearly ended in a riot. Dozens of neighborhood residents swarmed police as they worked to take three suspects into custody during the stop. Multiple cameras, including the dashboard units mounted in patrol cars and others on one police officer's TASER captured the melee. Two of the three suspects were able to escape because of the crowd's actions. A number of citizen complaints were filed with the department after the incident, Assistant Chief Chris Velasquez said Monday. Coupled with a use of force by officers, that automatically starts an administrative review. "The biggest goal right now is to get any and all evidence that is out there," Velasquez said. "That means any and all video or photographs circulating around. "There were a lot of emotions out there and it led to a very dangerous situation for the public and for the police officers," he added. Velasquez said rumors circulated through the community that police had shot someone and that drew a larger, more belligerent crowd.

OCALA - Ocala police tried to pull over an Ocala man driving a tow truck Monday morning to question him about a sex crime reportedly committed earlier in the day. Ten minutes and nine miles later, the driver faced several unrelated felony charges. Bret A. Wass, 28, driving the tow truck and pulling a sports utility vehicle, led police officers and Marion County sheriff's deputies on a 9-mile chase through Ocala just after 9 a.m, according to police reports. Wass raced the tow truck from State Road 200 and 17th Street to County Road 475 where, after almost striking a sheriff's deputy, the vehicle slammed into a tree at the entrance to the Brookstone subdivision, the report said. "We recognized his vehicle and wanted to question him," said Ocala police spokesman Sgt. Lou Biondi. "We tried to do a traffic stop, but he didn't stop." Biondi said Wass was a suspect in a sexual assault case that occurred around 8 a.m. Monday morning. The victim told police what kind of vehicle the suspect was driving. During the chase, officers said Wass was traveling at speeds up to 60 mph. Marion County Sheriff Sgt. Jeff Gold responded to the chase and got ahead of Wass on County Road 475 to lay down stop sticks. He then came face to face with Wass, who allegedly turned to miss the spike strips and reportedly barreled straight toward him. "They were coming up northbound on 475 and I looked straight at him," Gold said. "I saw him look right at me and cut the wheel." Gold dove out of the path of Wass, who slammed into Gold's car before running into a tree. "There's no doubt in my mind he was intentionally aiming at me, I mean, he missed me by inches," Gold said. "I've been doing this for about 18 years now, but I have never been more scared for my life. "It was a mighty big vehicle to have running down on you." Wass suffered multiple injuries in the crash and was taken under police escort to Shands at the University of Florida in Gainesville. Biondi said he will be charged with felony fleeing and eluding, attempted murder and aggravated assault on a law enforcement officer. The investigation into the sexual assault case is ongoing.

He took police for a wild ride on I-95 smashing into a couple of police cars and one man's Mercedes. Most of the pursuit was captured by the police cameras. It was 2 in the afternoon Memorial Day, and Boynton Beach police officers had just started getting reports of a reckless driver. "Oh my God. Oh my God, he almost hit us", said one woman who called herself Stephanie on a 9-1-1 call. "This guy ran another guy off the road." Several callers describe a white station wagon weaving in and out of traffic near Seacrest Avenue and Boynton Beach Boulevard. "I think he's really drunk or something; he just pushed us right off the road," said Jason Gaynor, another person who called 9-1-1. Police say it was Mike Timmons behind the wheel. At first, the officers say they were trying to pull Timmons over on Boynton Beach Boulevard but had no plans to chase up I-95. They followed him to the on-ramp, and, then, bang. Timmons rear-ended a Mercedes. Cops say he had plenty of room to avoid the collision. "He intentionally ran into the back of the car. A whole other ball game," said Major Frank Briganti. At that point, officers say, they knew Timmins was desperate and dangerous. Once on the interstate, he slammed on his breaks trying to get one of the police cruisers to hit him. The police drove around him and attempted to box him in. But, he didn't stop there. He swerved into one police car, pulled a u-turn on I-95 and ran head first into another police car. "He just rammed my car. He just ran into one of our patrol vehicles. He ran into several of our vehicles," said one of the officers involved in the chase. Timmins faces a bunch of charges, including reckless driving and aggravated battery. The officers who were hit are a little banged up, but they'll be ok. Cops: 'Erratic' motorist hits 3 police cars during I-95 chase Fort Lauderdale, FL, "Sun-Sentinel"; Boynton Beach -- An "erratic" driver hit three police cruisers and another car in a chase through the city that ended on Interstate 95 Monday afternoon. About 2 p.m., Boynton Beach Police responded to reports of a white station wagon weaving in and out of traffic while going south on Seacrest Boulevard, police spokeswoman Stephanie Slater said. The car continued west on Boynton Beach Boulevard, turned onto the ramp to I-95 and hit a Mercedes, Slater said. The station wagon drove north on I-95, with Boynton Beach police in pursuit. During the chase, the station wagon "rammed" three police cars before the driver stopped and tried to escape on foot, Slater said. Mike Timmins, 46, of 1191 S. Ocean Boulevard in Delray Beach, was quickly captured and found to be in possession of marijuana, Slater said. Simmons faces charges of aggravated assault, aggravated battery, reckless driving, leaving the scene of an accident, possession of marijuana and resisting arrest without violence. No police officers were injured in the pursuit and the driver of the Mercedes was not injured, Slater said.
