KIMBERLY POTTER TRIAL DAY 3 (2021)
Testimony continued for a third day Friday in the trial of former Brooklyn Center police officer Kimberly Potter, who's charged with first- and second-degree manslaughter in Daunte Wright's April 11 death. Friday morning, jurors heard from Sgt. Mychal Johnson, who was the patrol sergeant that responded to assist Potter and Officer Anthony Luckey with Wright's traffic stop. He's since left the Brooklyn Center Police Department and now works for the Goodhue County Sheriff's Office. In addition to seeing Johnson's body and dash camera videos from that day, jurors heard Johnson explain what he was doing during the traffic stop. He explained that he reached into the car when Wright was struggling with Luckey to make sure the car was turned off and ensure Wright couldn't shift the car and drive away. He noted he grabbed Wright's right arm to prevent him from operating the car before Potter fired and that his feet were always on the ground outside. The defense tried to portray him as being in danger of being dragged by Wright's car and seriously injured or killed; the state noted he was holding onto the inside of the vehicle while his feet were on the ground outside, and he was ready to quickly stand up as he did after Potter fired her gun and before the car sped off. Johnson explained how, after the shooting, he took Potter's gun and gave her his weapon to preserve her gun for evidence. He also said he later took the ammunition out of the gun he'd given Potter after an officer was concerned she'd harm herself. In portions of Johnson's bodycam video after the shooting, Potter could be heard saying, "Oh God, what have I done? What have I done?" and "I don't know what happened." While his video played in court, Potter shook and cried, putting her head in her hands at times. Wright's mother, Katie Bryant, was also in court and cried quietly during the video. In the afternoon, Acting Brooklyn Center Police Chief Tony Gruenig explained his role as a commander on April 11 and confirmed the Minnesota Bureau of Criminal Apprehension was called to investigate the shooting. BCA Assistant Special Agent in Charge Charles Michael Phill, who was the agent called, then described the BCA's role in responding and collecting evidence from the scene. Before Judge Chu and attorneys for both sides discussed autopsy pictures, Chu adjourned court for the day at 2:37 p.m. due to the inclement weather.

Taser and use of force training dominated the testimony during Day 5 of the trial of former Brooklyn Center Police officer Kimberly Potter. Prosecutors called two officers to the stand: Commander Garett Flesland and Sergeant Mike Peterson. Flesland testified first. He explained Potter was a field training officer on April 11 and wore her Taser on her left side, he walked the jury through her Taser certifications and demonstrated for jurors the different ways an officer can pull a Taser from its holster. During cross examination, defense attorney Earl Gray grilled Flesland about whether use of force was justified in this situation. He asked, “Another officer is in the front seat laying over the passenger, trying to stop this guy from going, and [the driver] is ignoring the warnings ‘Taser, Taser, I’m going to Tase you’, you have a right to use deadly force to save that cop, that police officer that’s lying over the seat, correct?”. After Judge Chu overruled the state’s objection, Flesland replied, “Yes but I wasn’t there.” The line of questioning comes just days after Gray elicited a similar response from former Brooklyn Center Police Sergeant Mychal Johnson. On Friday, Gray asked, “Based on these videos and the conduct of Daunte Wright, as far as you’re concerned, and you were there, Potter would’ve had a right to use a firearm, right?” and Johnson responded, “Yes.” The state filed a motion on Monday asking Judge Chu to strike Sergeant Mychal Johnson’s opinion on the use of force and limit future testimony as well. On Tuesday morning, Judge Chu ruled that officers can testify about whether Taser-use or use of force was appropriate. “I believe that the police officers due their training are entitled to render an opinion on that,” said Judge Chu. The state painstakingly paged through training and policy documents as it questioned its two witnesses. The courtroom reporters noted at least one juror nodded off during the testimony. “The state, in the last two days, seems to have decided because they got hurt so hard by Officer Johnson that if they bury the jury in information about how careful you're supposed to be, that might be enough,” said Jack Rice, a Twin Cities attorney who is not affiliated with Potter’s case. “The problem is that jurors are people and they fall asleep and they get bored.” During Sgt. Peterson’s testimony, prosecutors pointed out BCPD officers are trained to know the difference between a gun and a Taser. “There’s a paragraph here about confusing a handgun with a Taser, correct?” asked Assistant Attorney General Matthew Frank. Peterson, who is an instructor, replied yes and confirmed it's addressed during training. In response to another question from Frank, Peterson testified that he is not aware of any other BCPD officers drawing their handgun when they meant to use a Taser. “If I’m prosecuting this case, and I'm a former prosecutor, you think about what a witness can give the jury that will help your case,” said Rice. “Rather than move slowly and ploddingly towards it, you go straight out and you say there are three things that we're going to talk about. […] The point is to create structure but to create evidence that matters. If you can't grab this jury, it doesn't exist. The evidence doesn't matter if they don't hear it.” He said the state appeared to struggle with that approach on Tuesday. “I think that they have actually made the defense's case stronger, not weaker,” said Rice. “What's really interesting to me now is that […] the defense even said very clearly, ‘Put Kim Potter on the stand’. The question now becomes: the state's job was so poorly done, do you even put her on the stand? Except for the fact that you promised that you would - that's the problem that the defense has right now.”

KIMBERLY POTTER TRIAL DAY 8 (2021)
Former Brooklyn Center police officer Kimberly Potter took the stand in her own defense on Friday, telling jurors her account of what happened on April 11. Potter said, after Officer Anthony Luckey told Daunte Wright not to tense up, the stop "just went chaotic." Potter then said she saw fear in Sgt. Mychal Johnson's face like "nothing I've seen before" and then didn't realize she'd shot Wright until Wright yelled he'd been shot. Potter cried as she discussed Wright's shooting and as the state later played segments of her body camera video. She also was asked if she would've pulled over Wright if she was alone and not with Luckey, and responded, "Most likely not there." The state highlighted the extensive training she received over her career, the fact that she'd carried a Taser since 2005 and, except for a brief period when she first got the Taser, that she carried the Taser on her left side and gun on her right for over a decade. Assistant Attorney General Erin Eldridge also noted the de-escalation training Potter had, specifically since she worked as a crisis negotiator. Potter cried frequently during cross-examination, at one point saying through tears, "I'm sorry it happened. I'm so sorry." As Eldridge said Potter knew deadly force was unreasonable and grilled her for not trying to provide aid or relay information to other officers, Potter replied, "I didn't want to hurt anybody." The former officer also said she resigned from the department after shooting Wright because "There was so much bad things happening. I didn't want my coworkers and I didn't want anything bad to happen to the city." Her testimony came after Laurence Miller — who has a doctoral degree in psychology and has specialties in forensic psychology, neuropsychology and police psychology — testified about action error and how someone can think they're doing one thing, like grabbing a Taser, when they actually do another, such as grab a gun, when under extreme stress. The state pushed back against his testimony by highlighting the extensive training officers receive to handle that stress and the measures taken — such as the differences between a Taser and gun and the sides they're carried on — to mitigate weapon confusion. The defense rested its case just before 2 p.m. and, after Judge Regina Chu reminded jurors not to discuss or watch anything about the case, dismissed them for the weekend. Court is scheduled to reconvene Monday at 9 a.m. when closing statements and final jury instructions will be presented before the jury begins deliberations.
